In this procurement, the environment is not weighted as an award criteria by 30%. The contracting authority has chosen to have strict minimum environmental requirements, which will clearly give a better environmental effect than setting up the environment as an award criteria. According to the Public Procurement Regulations § 7-9 (4) first period, the Contracting Authority is obliged to state a justification for this in the competition documents. The contractual requirements in this procurement concern the use of zero emission or biogas vehicles. Such requirements have been assessed to have a significantly better environmental effect than using the award criteria for transport in the contract period. Obligatory requirements ensure to a greater degree that the desired environmental effect is actually achieved, whilst the award criteria do not guarantee that the tender with the best environmental achievement wins the competition. The exclusion provisions in the Procurement Regulations § 7-9 fourth section will therefore apply. In this competition there are also concrete minimum requirements for machines and equipment that shall use zero emission technology. For machines and vehicles where zero emissions or biogas are not required, euro class 6/VI shall be used as a minimum and certified sustainable bio-fuel in addition to the turnover requirements.
