Proof of registration in the professional or commercial register in accordance with the legal provisions of the country in which the applicant/tenderer is based. If not registered, submission of a business registration that identifies at least the authorized representatives.

Average annual number of employees

The average annual number of employees in the executing office location in the last three years must be at least 10 (excluding contractors/non-staff). Staff resources must be in the relevant disciplines to which the invitation to tender is related. Each discipline and number for each executing office location must be recorded separately. Regarding the executing office a distinction must be made between permanent staff and contractor personnel. The disciplines must include at least the following disciplines: Project manager, GIS expert, Senior environmental expert.

Average annual turnover

The average annual turnover of the last 3 (three) completed financial years for which financial figures are available relating to services comparable to the services to be awarded must be at least EUR 1.5 million (net) for each of the last 3 (three) completed financial years.

At least 3 particularly relevant (comparable) references with a contract value of minimum EUR 100,000 involving an EIA must be submitted. The references must be within the last maximum fifteen (15) years and comparable in type, scope, and complexity to the service being tendered. The references must include at least the following information to demonstrate comparability: Reference title, Client (contracting authority), Contact person incl. contact details, Contracting entity which signed the contract with the Client, Brief description of the services performed including a confirmation that the reference is comparable to the tendered services described in Attachment B.1 Scope of Work (i.e. the reference includes performance of environmental surveys, preparation of EIA documentation, execution of permitting procedure for linear infrastructure projects in Germany), Confirmation that the applicant has experience with EIA permit application in Germany for linear infrastructure projects, Confirmation that the applicant has worked under German permitting requirements and associated legal framework, Contract value in EUR (net), Execution period.

Declaration on sanctions against Russia

The applicant does not belong to the persons or companies mentioned in Article 5k (1) of Regulation (EU) No. 833/2014, including by Art. 1 No. 25 of Regulation (EU) 2025/395 of the Council of February 24, 2025, and subsequent amendments as amended from time to time, concerning restrictive measures considering actions by Russia that destabilize the situation in Ukraine, who have a connection to Russia as defined in the regulation. This includes connections through Russian nationality, establishment in Russia, participation of a natural person or company with Russian connection holding more than 50% shares, or acting on behalf of or at the instruction of such persons or companies. Subcontractors, suppliers, or companies whose capacities are relied upon, accounting for more than 10% of the contract value, also do not belong to this group. It is confirmed and ensured that, even during the term of the contract, no such entities are involved.

Knowledge of German Directives

The contractor will be at the time of both tendering and execution of the Scope of Work familiar with all applicable relevant directives in the German market to ensure acceptance by German authorized body including the following non exhaustive list: Approval Planning (Genehmigungsplanung), Coordination with German authorities.

Declaration of self-cleaning measures (if applicable) in accordance with § 125 GWB.

Declaration of reliance on capabilities

To demonstrate eligibility with regard to economic and financial standing, as well as technical and professional ability, in accordance with § 47 SektVO.
